Welcome to Hobby Card Index. These Terms of Service govern your access to and use of the Hobby Card Index application, website, and related services. By accessing or using Hobby Card Index, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Service” refers to the Hobby Card Index application, including all features such as price tracking, portfolio management, market analysis, card scanning, and related tools.

“User,” “you,” or “your” refers to any individual who accesses or uses the Service.

“We,” “us,” or “our” refers to Hobby Card Index and its operators.

“Content” refers to all data, text, images, analytics, and other materials available through the Service.

“Third-Party Services” refers to external services integrated with Hobby Card Index, including but not limited to eBay and Google Gemini AI.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under the age of majority where you live (19 in British Columbia), you represent that you have your parent or legal guardian’s consent to use the Service. By using Hobby Card Index, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Membership

3.1 Account Creation

Certain features of Hobby Card Index may require you to create an account or subscribe to a membership plan. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Membership Tiers

Hobby Card Index offers the following membership tiers:

All prices are in U.S. dollars (USD). Plan features and current pricing are shown on the in-app pricing page at the time of purchase, which controls in the event of any conflict with this section.

3.3 Billing and Payments

Membership fees are billed on a recurring basis. You authorize us to charge your selected payment method for the applicable fees. All fees are non-refundable except as required by applicable law.

3.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account.

4. Use of the Service

4.1 Permitted Use

You may use Hobby Card Index for personal, non-commercial purposes related to tracking, managing, and analyzing sports cards and collectibles. You agree to use the Service in compliance with all applicable laws and regulations.

5.1 Our Intellectual Property

The Service, including its design, features, functionality, code, graphics, logos, and all associated Content, is the exclusive property of Hobby Card Index and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

5.2 User Content

You retain ownership of any content you submit to the Service (such as collection data, notes, or custom tags). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

5.3 Third-Party Content

Card images, pricing data, and other content sourced from third parties (including eBay) remain the property of their respective owners. Such content is displayed under applicable licenses and terms of those third parties.

6. Price Data and Market Information

6.1 No Financial Advice

IMPORTANT: Hobby Card Index is NOT a financial advisory service. All pricing data, market trends, analytics, AI-generated insights, and related information provided through the Service are for informational and entertainment purposes only. Nothing on Hobby Card Index constitutes financial advice, investment advice, or a recommendation to buy, sell, or hold any collectible or asset.

6.2 Data Accuracy

While we strive to provide accurate and up-to-date pricing information, we make no warranties or representations regarding the accuracy, completeness, reliability, or timeliness of any data displayed on the Service. Prices are derived from third-party sources including eBay completed sales and real sold-price data, and may not reflect actual current market values.

6.3 Investment Risk

Collectibles markets are inherently volatile and speculative. Past performance does not guarantee future results. You acknowledge that buying, selling, or trading collectibles involves significant financial risk, and you assume full responsibility for any financial decisions made based on information obtained through the Service.

7. AI-Powered Features

7.1 Card Identification

Hobby Card Index uses Google Gemini AI for card identification and analysis. AI-generated results are provided on an “as-is” basis and may contain errors or inaccuracies. You should independently verify any AI-generated information before relying on it.

7.2 Market Analysis

AI-generated market analysis, predictions, and insights are algorithmic outputs and should not be treated as expert opinions or professional advice. These features are experimental and may not always produce reliable results.

Hobby Card Index integrates with and displays data from third-party services including:

We are not responsible for the content, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms and policies. We do not endorse or guarantee any third-party service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOBBY CARD INDEX AND ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

You agree to indemnify, defend, and hold harmless Hobby Card Index and its operators, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit through the Service.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content or data available through the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the “Last Updated” date and, where practicable, by providing additional notification through the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

14.2 Informal Resolution First. Most disputes can be resolved without a formal proceeding. Before starting arbitration or going to court, you agree to first contact us at [email protected] and give us at least 30 days to resolve the dispute informally and in good faith.

14.3 Binding Individual Arbitration (U.S. users). If you are located in the United States, then except for the carve-outs in Section 14.5, you and Hobby Card Index agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may be conducted by phone, by video, or in writing where the rules allow, so you do not have to travel. Judgment on the award may be entered in any court of competent jurisdiction.

14.4 Class-Action Waiver (U.S. users). To the fullest extent permitted by law, disputes will be brought only in your individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court rather than arbitration.

14.5 Carve-Outs. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to protect its intellectual property or stop unauthorized use of the Service. Nothing in Sections 14.3–14.4 applies where, or to anyone for whom, such arbitration or class-action waiver is prohibited or unenforceable under applicable law.

14.6 30-Day Opt-Out. You may opt out of the arbitration and class-action-waiver provisions (Sections 14.3–14.4) by emailing [email protected] within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.

14.7 Other Users; Courts. For users not subject to Section 14.3, and for any dispute not resolved by arbitration, the courts located in British Columbia, Canada will have exclusive jurisdiction, and you submit to the jurisdiction of those courts. To the extent any dispute proceeds in court rather than arbitration, you and Hobby Card Index waive any right to a jury trial.

14.8 Your Consumer Rights Survive. Nothing in these Terms limits any non-waivable rights you may have as a consumer under the laws of British Columbia (including the Business Practices and Consumer Protection Act) or under the mandatory consumer-protection laws of your own country, province, or state, to the extent they cannot be excluded by agreement.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Hobby Card Index regarding your use of the Service.
